1. Definitions

In these Terms of Service, the following terms have the meanings set out below:

• "Platform" means the Unrelenting Resilience web application, mobile application, progressive web application, and all associated features, content, and services available at unrelenting-resilience.ca.
• "Operative" or "You" means an individual who has registered for a personal account on the Platform.
• "We," "Us," or "Our" means Piero Corradetti Consulting, operating as Unrelenting Resilience, incorporated in Ontario, Canada.
• "The Eye" means the AI-powered mentor feature integrated into the Platform.
• "Comm-Link" means the in-platform secure messaging and community communication system.
• "Mission Board" means the daily activity and micro-action interface presented to Operatives.
• "8 Pillars" means the eight evidence-informed domains of well-being that structure the program: Be Present, Be Positive, Be Kind, Nurture Relationships, Grow Your Mind, Optimize Your Situation, Care for Your Body, and Find Your Meaning.
• "Content" means all text, audio, video, assessments, activities, AI-generated responses, course materials, and other materials made available through the Platform.
• "User Content" means any content you submit to the Platform, including reflection logs, journal entries, Comm-Link messages, and assessment responses.
• "XP" means experience points awarded within the Platform's gamification system for completing activities and course modules.

2. Acceptance of Terms

By accessing or using the Platform in any way — including creating an account, completing activities, using The Eye, or participating in any cohort or community feature — you agree to be bound by these Terms of Service, our Privacy Policy, our Cookie Policy, and our Mental Health and Wellness Disclaimer (collectively, the "Legal Documents").

If you do not agree to these terms, you must not access or use the Platform.

We may update these Terms of Service from time to time. When material changes are made, we will notify you through the Platform and require you to re-accept before continuing to use your account. Continued use following re-acceptance constitutes your agreement to the updated terms.

3. Eligibility

To create an individual account on the Platform, you must:

• Be at least 18 years of age. If you are between 13 and 17 years of age, you may only access the Platform with the verified consent of a parent or legal guardian, and only where the Platform has been deployed in an institutional context that includes appropriate safeguards.
• Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
• Not be prohibited from using the Platform under any applicable law.
• Provide accurate, current, and complete information during registration and maintain that information throughout your use of the Platform.

We reserve the right to verify eligibility and to suspend or terminate accounts where eligibility requirements are not met.

4. Account Registration and Security

When you create an account, you agree to:

• Provide truthful and accurate registration information including your name and email address.
• Keep your login credentials confidential and not share them with any other person.
• Notify us immediately if you become aware of any unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account, whether or not authorized by you.

We reserve the right to refuse registration, cancel accounts, or remove usernames at our discretion, including where we determine that account information is inaccurate, offensive, or in violation of these terms.

You may not create more than one individual account. Duplicate accounts may be suspended without notice.

5. Nature of the Platform

Unrelenting Resilience is a mental fitness training platform. It is expressly not a mental health service, therapeutic program, medical service, or clinical intervention of any kind.

The Platform is designed for use by non-clinical populations as a tool for general well-being maintenance, habit formation, and mental fitness training. It is not designed or suitable as a primary resource for individuals experiencing acute mental health conditions, psychiatric crises, or symptoms requiring clinical attention.

By using the Platform, you acknowledge that:

• Participation in the program does not create a therapeutic relationship between you and Piero Corradetti Consulting.
• The 8 Pillar activities are general wellness practices and are not individually prescribed based on a clinical assessment of your needs.
• The program draws on peer-reviewed research, but no specific mental health outcome is guaranteed or implied.
• You have read and accepted the Mental Health and Wellness Disclaimer, which forms part of your agreement with us.

Crisis and emergency resources are available at all times within the Platform and are listed in full in the Mental Health and Wellness Disclaimer.

6. The Eye — AI Mentor

The Eye is an artificial intelligence feature integrated into the Platform. By using The Eye, you acknowledge and agree that:

• The Eye is an AI tool and is not a licensed mental health professional, therapist, physician, counsellor, or any other regulated health practitioner.
• Responses generated by The Eye are informational and educational in nature only and do not constitute clinical advice, diagnosis, or treatment recommendations.
• You should not use The Eye as a substitute for professional mental health support, medical advice, or crisis intervention.
• The Eye is specifically prompted to provide educational content related to the 8 Pillars of the program. Its responses are generated by an AI system and may contain errors or inaccuracies.
• We are not liable for any harm arising from your reliance on responses generated by The Eye.
• Conversations with The Eye are subject to our Privacy Policy. They are not confidential clinical communications and do not attract professional privilege.

7. Permitted Use and Restrictions

7.1 Permitted Use

Subject to these Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for your personal, non-commercial use as an individual Operative.

7.2 Prohibited Conduct

You must not:

• Use the Platform for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any part of the Platform, its servers, or any system or network connected to the Platform.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software forming part of the Platform.
• Scrape, crawl, or otherwise extract data from the Platform using automated means without our prior written consent.
• Reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Content from the Platform without our express written permission.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.
• Use the Comm-Link or any community feature to solicit, advertise, or promote any third-party product or service.
• Interfere with or disrupt the integrity or performance of the Platform or its underlying infrastructure.
• Share your account credentials or allow any other person to access the Platform using your account.

8. User Content

8.1 Ownership

You retain ownership of all User Content you submit to the Platform, including reflection logs, journal entries, and Comm-Link messages.

8.2 Licence Grant

By submitting User Content to the Platform, you grant Piero Corradetti Consulting a non-exclusive, royalty-free, worldwide licence to store, process, and display your User Content solely for the purpose of providing the Platform services to you. This licence terminates when you delete your User Content or close your account, subject to any retention obligations set out in our Privacy Policy.

You also grant us a perpetual, irrevocable, royalty-free licence to use anonymized and aggregated data derived from your User Content for the purposes of improving the Platform, conducting research, and developing our services. This anonymized data cannot be used to identify you personally.

8.3 Content Standards

You are solely responsible for your User Content. You represent and warrant that:

• You have all necessary rights to submit the User Content and to grant the licences described above.
• Your User Content does not infringe the intellectual property rights, privacy rights, or other rights of any third party.
• Your User Content does not contain material that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.

We reserve the right to remove any User Content that we determine, in our sole discretion, violates these standards or these Terms of Service.

9. Gamification, XP, and Leaderboards

The Platform incorporates gamification elements including XP points, leveling, leaderboards, challenges, and badges. You acknowledge that:

• XP, levels, badges, and leaderboard rankings have no monetary value and cannot be redeemed, transferred, or exchanged for cash or any other benefit outside the Platform.
• We may modify, reset, or discontinue any gamification feature at any time without notice or compensation.
• Leaderboard participation may be visible to other Operatives within the same cohort or community, as described in our Privacy Policy.
• Any attempt to manipulate XP scores, leaderboard rankings, or gamification systems through unauthorized means is prohibited and may result in account suspension.

10. Intellectual Property

All Content on the Platform — including but not limited to the 8 Pillar framework, Mission Board structure, program curriculum, The Eye feature, Comm-Link system, and all associated text, graphics, software, and audio-visual materials — is the exclusive property of Piero Corradetti Consulting or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

The following names, terms, and identifiers are proprietary to Piero Corradetti Consulting:

• Unrelenting Resilience™
• The Eye™
• Comm-Link™
• Mission Board™
• Operative (as used in the context of the Platform)™
• The Reversibility Principle™

You may not use any of the above identifiers, or any confusingly similar names or marks, without our prior written consent.

Nothing in these Terms of Service transfers any intellectual property rights to you. The limited licence granted in Section 7.1 does not include any rights to sublicense, resell, or commercially exploit any Platform Content.

11. Subscriptions, Payments, and Cancellation

11.1 Free and Paid Tiers

The Platform may offer both a free access tier and one or more paid subscription tiers. The features available under each tier are described on the Platform's pricing page, which may be updated from time to time.

11.2 Payment

If you subscribe to a paid tier, you agree to pay all applicable fees as described at the time of purchase. All fees are stated in Canadian dollars unless otherwise indicated. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.

11.3 Renewal

Paid subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. We will provide advance notice of any fee changes before they take effect.

11.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have paid.

11.5 Refunds

Refunds are governed by our Refund and Cancellation Policy, which is accessible through your account settings and the Platform footer. We do not provide refunds for partial billing periods except where required by applicable consumer protection law.

12. Privacy and Data

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated by reference into these Terms of Service. By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

The Platform is designed to comply with applicable Canadian privacy law (PIPEDA and applicable provincial legislation), the European General Data Protection Regulation (GDPR), and the California Consumer Privacy Act (CCPA). Details of your rights under each applicable regime are set out in the Privacy Policy.

13. Disclaimers and Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PIERO CORRADETTI CONSULTING DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be available without interruption, error, or security breach.
• Any Content on the Platform is accurate, complete, current, or suitable for your specific circumstances.
• The Platform or The Eye will meet your mental health, wellness, or personal development needs.
• Any defects in the Platform will be corrected.

Nothing in this section limits or excludes any warranty that cannot be disclaimed under applicable Canadian consumer protection legislation.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PIERO CORRADETTI CONSULTING, ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM.

Our total aggregate liability to you for any claims arising under or related to these Terms of Service shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim, or one hundred Canadian dollars ($100.00 CAD), whichever is greater.

These limitations apply regardless of the theory of liability (contract, tort, negligence, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

15. Indemnification

You agree to defend, indemnify, and hold harmless Piero Corradetti Consulting and its officers, directors, employees, contractors, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Platform in violation of these Terms of Service.
• Your User Content.
• Your violation of any applicable law or the rights of any third party.
• Any misrepresentation you make in connection with your use of the Platform.

16. Suspension and Termination

16.1 Termination by You

You may close your account at any time through your account settings. Upon closure, your access to the Platform will be terminated and your personal data will be handled in accordance with our Privacy Policy.

16.2 Termination by Us

We may suspend or terminate your access to the Platform at any time, with or without notice, if we determine in our sole discretion that:

• You have violated these Terms of Service or any of our Legal Documents.
• Your conduct poses a risk to other users, the Platform, or Piero Corradetti Consulting.
• We are required to do so by applicable law or a valid court or regulatory order.
• The Platform is being discontinued or materially restructured.

16.3 Effect of Termination

Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms of Service that by their nature should survive termination — including Sections 10 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), and 18 (Governing Law) — shall survive.

17. Third-Party Services and Links

The Platform may integrate with or contain links to third-party services, websites, or tools. These integrations are provided for convenience only. We do not control, endorse, or accept responsibility for any third-party content, services, or privacy practices. Your use of any third-party service is governed by that party's own terms and privacy policy.

18. Governing Law and Dispute Resolution

18.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

18.2 Dispute Resolution

In the event of any dispute arising out of or in connection with these Terms of Service or your use of the Platform, you agree to first contact us at the address set out in Section 20 and attempt to resolve the dispute informally. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue the remedies available under applicable law.

18.3 Jurisdiction

You agree that any legal proceedings arising out of these Terms of Service shall be brought exclusively in the courts of competent jurisdiction located in the Province of Ontario, Canada, and you irrevocably submit to the personal jurisdiction of those courts.

19. General Provisions

• Entire Agreement: These Terms of Service, together with the Privacy Policy, Cookie Policy, and Mental Health and Wellness Disclaimer, constitute the entire agreement between you and Piero Corradetti Consulting with respect to your use of the Platform.
• Severability: If any provision of these Terms of Service is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms of Service without our prior written consent. We may assign our rights and obligations without restriction.
• No Agency: Nothing in these Terms of Service creates a partnership, joint venture, employment, or agency relationship between you and Piero Corradetti Consulting.
• Language: These Terms of Service are written in English. Any translated versions are provided for convenience only. In the event of any inconsistency, the English version prevails.
• Force Majeure: We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, pandemics, governmental restrictions, or infrastructure failures.
